Welcome to Mycospring. We are a company engaged in the cultivation, development and marketing of medicinal mushroom products, which can be purchased on our website at www.mycospring.com (the " Site " and the " Services ").

For ease of reading, the Terms of Use are written in the masculine gender, but refer to both men and women. Where the words are written in the plural, the singular gender is also intended, and vice versa.

By using the Services, you confirm that you have read and understood the Terms of Use and Purchase, including the terms detailed in the Privacy Policy located at [link] (collectively – the " Terms " or " Terms of Use ", " Privacy Policy " respectively) which form an integral part of the Terms. You agree that as a user of the Services, the Terms will bind you, and that you will act in accordance with any applicable law in connection with the use of the Services, so please read them carefully before using the Services.

The Terms constitute a binding and enforceable legal agreement between us, Mycospring Ltd. (" Mycospring " or " we "), and you.

The Services are operated and managed by us for the purpose of marketing and selling our products.

As a visitor to the Site, you will be able to view information about the type of products we offer as well as additional content related to the Services (the " Information and/or Content "). Nothing in the Information and Content, the Services, or the actions that can be taken through them, including contacting us through the various communication channels, obligates us to enter into any business agreement or arrangement with you, enter into a partnership, employ you, or provide you with any service, engage in any activity now or in the future, or conduct any other discussion or negotiation with you.

Using the bathroom

Registration and User Account – " User " is any person who enters the Site, browses the Site, or makes any use of the Site, including performing any action through the Site.

In order to make a purchase on the Site, the User will be asked to open an account on the Site. By creating an account, you agree to: (1) provide true, accurate, complete and current information, as well as to update your information as necessary; (2) maintain the security of your password and not allow others to access your account; (3) notify us as soon as possible if you believe there have been any breaches of security of the Services or your account; and (4) monitor your account to limit prohibited use, including by minors. The services, information and content are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied, including, without limitation, representations, warranties, verification or fitness for a particular purpose.

Use of the Services or related websites may expose you to the dangers of using the Internet, including: hacking, attacks, intrusion, viruses, etc. It is recommended that you install appropriate protection and security software before using the Services.

Information security

However, Microspring does not warrant that the services and the site are fully protected against attacks or intrusions into its computers or systems or unlawful disclosure of stored information. In the event that a third party takes such action and accesses or misuses information stored by Microspring (including, by unlawfully disclosing information), you will have no claim, claim, demand or action against Microspring and Microspring will not be liable for any damage or loss of any kind incurred by you or any other third party as a result.

Subject to any law, Mycospring's aggregate liability to a user under any legal cause shall not exceed the total amount that the user actually paid to Mycospring during the six (6) months prior to the occurrence of the event that constitutes the cause of his claim.

To the extent that the Site allows the User to upload content, Mycospring may reject, prevent, remove or not upload content to the Site that, in its sole discretion, may harm its name, another person, public sentiment, is offensive, may violate rights, violate privacy, violates the law or the Terms. A User who uploads content grants Mycospring a non-renewable, royalty-free license to use the content, and confirms that Mycospring may use his name and image in the context of publishing the content on the Site. The User is aware that the content will be exposed to the public and undertakes to refrain from any activity that may harm the good name of Mycospring. Uploading content is subject to these Terms and additional terms in the relevant sections of the Site.

Law and jurisdiction

In any dispute regarding these Terms of Use, no foreign law or international choice of law rules shall apply. The law applicable to these Terms of Use and the use of these Services shall be Israeli law only. With respect to any dispute arising out of or relating to the use of the Services, the courts of the Tel Aviv District shall have exclusive jurisdiction, and the exclusive place of jurisdiction shall be there.

Terms of purchase

Purchase on the website and the customer club

In order to make a purchase on the site, the user will be asked to open an account on the site.

When registering on the site or when placing an order through the site, the user will be automatically added to the Mycospring customer club (" Customer Club "). Various actions on the site will allow users who are members of the customer club to accumulate points. Accumulating 20 club points will entitle the customer to one shekel to use as a discount on future purchases on the site. The validity of each customer club point accumulated is one year from the date of its accumulation.

The products offered for purchase on the site

The products purchased through the site are intended for healthy people only. Mycospring's products do not constitute drugs or medical products of any kind and are not intended to prevent, diagnose, treat or cure any disease. The operation of the site, or any content therein, does not create or constitute a medical or other professional opinion. Any information or content appearing on the site is for informational purposes only and does not deal with medicine, is not intended and does not purport to replace any professional or medical advice or opinion. The content appearing on the site is not intended to serve as instruction, guidance, recommendation or advice for the use, change or discontinuation of any medication and should not be used or relied upon for medical decisions, diagnosis or treatment .

Each user confirms that before making any purchase on the site, he has consulted with his doctor and received permission from him to use the products. In the event of any medical problem, the user must contact his doctor.

Microspring does not undertake to provide any products continuously, on an ongoing basis or during any period and may change them, from time to time, at any time, at its sole discretion and without prior notice. Microspring may update the prices of the products appearing on the Site, from time to time and at its sole discretion.

Deliveries and orders

Deliveries will be provided to customers within 10 (ten) business days from the date of order confirmation, unless otherwise expressly stated at the time of placing the order. It is clarified that business days do not include rest days, holidays, holiday eves, official sabbaticals or delays arising from circumstances beyond the control of Microspring. Microspring may adjust the delivery times of the products through courier companies, in which case the delivery will also be subject to the delivery terms of those courier companies and their geographical coverage.

The products ordered on the site are for delivery in the State of Israel (in locations that are not restricted to security access) only. However, Mycospring does not guarantee that delivery will be possible in every location that meets the conditions of the previous sentence.

If the user is not present at the delivery location at the time of delivery, Microspring will be entitled to deliver the products to whoever is present at the time or, if no one is present, leave them near the entrance to the delivery location. Microspring will not bear any liability in connection with any loss, spoilage, breakage, damage or defect that may occur in connection with the delivery according to the previous sentence, and all liability for this will lie with the user.

In the event of weather that prevents or delays safe delivery, or other events beyond our control that prevent us from delivering your order on the agreed date, we will attempt to deliver your order as soon as possible.

Mycospring may from time to time determine a minimum order amount that will entitle the user to free shipping.

Prices and payment method

When you select the product you wish to purchase, the product price will appear on the purchase page. By confirming the order on the site, you agree to pay for all of the products you have chosen to purchase as part of the order, without the need for additional consent.

When placing an order and in order to provide the services, you will be asked to provide your payment method details (credit card, debit card or gift card). Microspring does not store this information, because the settlement is made by a third-party payment service provider whose services Microspring uses, and not directly by us. We are not responsible for the manner in which this provider processes the said information. Purchases on the website will be made using an Israeli credit card, or, to the extent we approve such, another valid payment method.

Transaction cancellation and returns

Mycospring's product return policy is subject to the provisions of the Consumer Protection Law 5741-1981 and the regulations established pursuant to it.

Cancellation of a transaction and return of products in this regard can be made within a period of up to 14 days from the date of receipt of the order, except when it concerns perishable goods with a short shelf life which, subject to any law, cannot be returned or cancelled. In order to cancel the transaction, the user must contact Mycospring and notify them of his desire to cancel the transaction.

Upon receipt of notification of the cancellation of the order, Microspring will refund the user's money for the order, but will be entitled, at its discretion and subject to the provisions of the law, to charge cancellation fees of up to 5% of the order value or 100 NIS, whichever is lower (except in cases where the cancellation of the transaction results from a defect in the product supplied).

As a general rule, product returns will only be possible when the product remains in its original packaging and the product's seal is maintained. The cost of shipping back to Microspring will be at the customer's expense only (even in the case where the customer was entitled to free shipping).

Microspring may, in exceptional cases at its discretion, cancel or disapprove orders placed on the site. For the avoidance of doubt, in the event of a cancellation of an order by Microspring, the user will not be charged, and if the user has already been charged, his money will be refunded.

Subscription service

Users of the Site will be permitted to join the Mycospring subscription service (the " Subscription Service ").

As part of the subscription service, the user will be able to choose to receive regular delivery of selected products at a predetermined frequency (30, 45 or 60 days) depending on the subscription route he has chosen.

When registering for the subscription service, the user confirms automatic billing of the payment method he provided according to the frequency of deliveries he selected, until the subscription is canceled.

Joining the subscription service will entitle the user to a 10% discount on the prices listed on the site. The discount will be valid on both promotions and product packages ("bundles").

The user may, by contacting customer service or by making a change in the personal area: (a) change the composition of the products in the subscription plan; (b) change the frequency of delivery, provided that the change is made at least 10 working days before the expected delivery date.

Coupon codes will not be redeemable on orders under the subscription program.

If a user wishes to terminate their membership in the subscription service, they must notify Microspring by changing the settings in the user's account or by contacting customer service. Such cancellation will take effect within three business days from the date the user provides notice of cancellation.

Mycospring reserves the right to change, terminate, or limit the terms of the subscription service at any time, with 30 days' prior notice to existing subscribers.

When placing an order and in order to provide the services, you will be asked to provide your payment method details (credit card, debit card or gift card). Microspring does not store this information, because the settlement is made by a third-party payment service provider whose services Microspring uses, and not directly by us. We are not responsible for the manner in which this provider processes the said information. Purchases on the website will be made using an Israeli credit card, or, to the extent we approve such, another valid payment method.

Transaction cancellation and returns

Mycospring's product return policy is subject to the provisions of the Consumer Protection Law 5741-1981 and the regulations established pursuant to it.

Cancellation of a transaction and return of products in this regard can be made within a period of up to 14 days from the date of receipt of the order, except when it concerns perishable goods with a short shelf life which, subject to any law, cannot be returned or cancelled. In order to cancel the transaction, the user must contact Mycospring and notify them of his desire to cancel the transaction.

Upon receipt of notification of the cancellation of the order, Microspring will refund the user's money for the order, but will be entitled, at its discretion and subject to the provisions of the law, to charge cancellation fees of up to 5% of the order value or 100 NIS, whichever is lower (except in cases where the cancellation of the transaction results from a defect in the product supplied).

As a general rule, product returns will only be possible when the product remains in its original packaging and the product's seal is maintained. The cost of shipping back to Microspring will be at the customer's expense only (even in the case where the customer was entitled to free shipping).

Microspring may, in exceptional cases at its discretion, cancel or disapprove orders placed on the site. For the avoidance of doubt, in the event of a cancellation of an order by Microspring, the user will not be charged, and if the user has already been charged, his money will be refunded.

Subscription service

Users of the Site will be permitted to join the Mycospring subscription service (the " Subscription Service ").

As part of the subscription service, the user will be able to choose to receive regular delivery of selected products at a predetermined frequency (30, 45 or 60 days) depending on the subscription route he has chosen.

When registering for the subscription service, the user confirms automatic billing of the payment method he provided according to the frequency of deliveries he selected, until the subscription is canceled.

Joining the subscription service will entitle the user to a 10% discount on the prices listed on the site. The discount will be valid on both promotions and product packages ("bundles").

The user may, by contacting customer service or by making a change in the personal area: (a) change the composition of the products in the subscription plan; (b) change the frequency of delivery, provided that the change is made at least 10 working days before the expected delivery date.

Coupon codes will not be redeemable on orders under the subscription program.

If a user wishes to terminate their membership in the subscription service, they must notify Microspring by changing the settings in the user's account or by contacting customer service. Such cancellation will take effect within three business days from the date the user provides notice of cancellation.

Mycospring reserves the right to change, terminate, or limit the terms of the subscription service at any time, with 30 days' prior notice to existing subscribers.
